{"id":52573,"date":"2014-01-30T11:55:02","date_gmt":"2014-01-30T09:55:02","guid":{"rendered":"http:\/\/germistoncitynews.co.za\/52573\/family-disputes-farm-usufruct\/"},"modified":"2014-01-30T11:55:02","modified_gmt":"2014-01-30T09:55:02","slug":"family-disputes-farm-usufruct","status":"publish","type":"post","link":"https:\/\/develop.citizen.co.za\/germiston-city-news\/opinion-edition\/2014\/01\/30\/family-disputes-farm-usufruct\/","title":{"rendered":"Family disputes farm usufruct"},"content":{"rendered":"<p>The reader explains that he originally owned the farm, which he sold to his father some years ago on the understanding that he, the reader, would have a usufruct over the dwellings.<\/p>\n<p>It seems that the arrangement was suitable to both parties as the reader continued to stay on the farm for a further 15 years. However, when his father passed away recently, certain issues surfaced.<\/p><div class=\"stream-item stream-item-in-post stream-item-inline-post aligncenter\"><\/div>\n<p>It has since transpired that the deceased purchased the farm in the name of the reader\u2019s niece. The niece now insists that the reader has no rights to stay on the farm.<\/p>\n<p>Unfortunately, the reader says there is no agreement in place regulating or proving the existing arrangement.<\/p><div class=\"stream-item stream-item-in-post stream-item-inline-post aligncenter\"><\/div>\n<p><span class=\"gmw_\">The situation seems to have come about in a strange way, says Schalk van <span class=\"gm_ gm_cc9e8b98-02e4-57f5-5079-36cbc65a8b08 gm-spell\">der<\/span> Merwe from Rawson Properties in Somerset West, Cape Town.<\/span><\/p>\n<p>\u201cProperty is transferred in a regulated and orderly fashion and is heavily document based.\u201d<\/p>\n<p><span class=\"gmw_\">The identities of the parties, the seller and purchaser, are typically set out in the documentation, which is signed, says Van <span class=\"gm_ gm_ef87c7d2-8030-0846-367f-99e02b4ff868 gm-spell\">der<\/span> Merwe.<\/span><\/p>\n<p>\u201cThe conveyancer in control of the transfer explains the process to the signatory when the various documents are signed. Our reader should therefore have noticed that his niece was the recipient of the property.\u201d<\/p>\n<p><span class=\"gmw_\">Van <span class=\"gm_ gm_85add0f3-8f73-2fe4-3310-a7b56412779b gm-spell\">der<\/span> Merwe says one would have expected the transaction to take place in the usual manner, with an agreement of sale being concluded between the seller and purchaser.<\/span><\/p>\n<p>\u201cIt would include the condition of usufruct and the usufruct would be registered over the property around the time of transfer.\u201d<\/p>\n<p><span class=\"gmw_\">From a contractual standpoint, the reader should examine the documentation giving rise to the transaction to ensure that the agreement of sale is valid, says Van <span class=\"gm_ gm_ad60341e-837e-da30-7db2-5dfda356921e gm-spell\">der<\/span> Merwe.<\/span><\/p>\n<p>\u201cIf the agreement is defective or the material requirements for the sale were not met, the transaction may be void or voidable.\u201d<\/p>\n<p><span class=\"gmw_\">Furthermore, the agreement may make provision for the registration of the intended usufructand this could perhaps still be put into effect, says Grant Hill of Miller Bosman Le Roux Attorneys in Somerset West.<\/span><\/p>\n<p>\u201cThe fact that our reader\u2019s father has since passed away doesn\u2019t help the matter, as his version will have to be inferred from the documentation alone.\u201d<\/p>\n<p>Hill says, aside from the contractual aspects, it may help the reader to consider the effect of the provisions of the Extension of Security of Tenure Act.<\/p>\n<p>\u201cThis legislation regulates certain rights of residence and restricts eviction if prescribed conditions are met.\u201d<\/p>\n<p>On the face of it, the reader seems to meet the Act\u2019s definition of an occupier, says Hill.<\/p>\n<p>\u201cThe Act states that \u2018occupier\u2019 means \u2018a person residing on land which belongs to another person, and who has or, on 4 February 1997 or thereafter, had consent or another right in law to do so.\u2019\u201d<\/p>\n<p>Hill says the definition goes on to mention certain exclusions, which the reader would have to consider.<\/p>\n<p>\u201cIf, in fact, our reader does qualify as an occupier, his residence on the property in question can only be terminated in accordance with the provisions of section eight under the Act.\u201d<\/p>\n<p>Unfortunately, without sufficient information, no definitive answer is possible, says Hill.<\/p>\n<p>\u201cBut the contractual and legislative ideas should give our
